LAND ACKNOWLEDGEMENT

We will begin by acknowledging that the land on which we gather is the traditional territory of the Three Fires Confederacy of First Nations (comprising the Ojibway, the Odawa, and the Potawatomie Peoples), and of the Huron-Wendat and Wyandot Peoples. We recognize the land as an expression of gratitude to those whose traditional territory we reside on, and a way of honouring the Indigenous people who have been living and thriving on the land since time immemorial. We value the significant historical and contemporary contributions of local and regional First Nations and all of the Original Peoples of Turtle Island.

REPORTS - INFRASTRUCTURE SERVICES

12.1

Kingsbridge Subdivision Phase 7A9A– Assumption of Surface Asphalt and Sidewalk

• It is recommended that:

  1. The recommendations in the letter regarding Kingsbridge Development – Phase 7A/9A dated May 30, 2023 from the consulting engineer, Baird AE BE ACCEPTED; and,

  2. The Surface Asphalt and sidewalks for the Kingsbridge Subdivision – Phase 7A/9A BE ASSUMED.

12.2

Kingsbridge Subdivision Phase 9B – Assumption of Surface Asphalt andSidewalk

• It is recommended that:

  1. The recommendations in the letter regarding Kingsbridge Development – Phase 9B dated May 30, 2023 from the consulting engineer, Baird AE BE ACCEPTED; and,

  2. The surface asphalt and sidewalk for the Kingsbridge Subdivision – Phase 9B BE ASSUMED.

Kingsbridge Subdivision Phase 10 B/D – Assumption of Underground Infrastructure, Base Asphalt and Curbs

• It is recommended that:

  1. The recommendations in the letter regarding Kingsbridge Development Phase 10B/D dated July 27, 2023 from the consulting engineer, Baird AE BE ACCEPTED; and,

  2. The underground infrastructure, curbs, road base and base asphalt for Kingsbridge Subdivision Phase 10B/D BE ACCEPTED and BE ASSUMED.

12.4

Regional Waste Management County By-law

• It is recommended that:

  1. Council SUPPORT the Corporation of the County of Essex By-Law 2023-40, being a by-law to transfer all power of the lower tier municipalities of the County of Essex with respect to the collection of waste and the delivery of such waste in the County of Essex, pursuant to the provisions of Sections 189 and 190 of the Municipal Act, 2001, S.O. 2001, c.25, as amended.

REPORTS - PLANNING AND DEVELOPMENT SERVICES

13.1

Zoning By-law Amendment ZBA-15-23 for 196 Fort Street

• It is recommended that:

  1. By-law 2023-089 being a by-law to amend Zoning By-law No. 1999-52, to amend the zoning for the subject lands known as 196 Fort Street be taken as having been read three times and finally passed and the Mayor and Clerk BE AUTHORIZED to sign same.

13.2

Street Naming – Brittany Crescent and Stone Street

• It is recommended that:

  1. The naming of a new street to be known as “Brittany Crescent” within the Brittany’s Gate subdivision development, BE APPROVED; and,

  2. The naming of a new street to be known as “Stone Street” entering the Brittany’s gate subdivision development, BE APPROVED.

Urban Structure Plan - Background Report

• It is recommended that:

  1. The report of September 25, 2023, entitled Urban Structure Plan Background Report BE RECEIVED for information.

13.4

Options to Address Zoning By Law 1999-52 as amended by 2019-028

• It is recommended that:

  1. Administration BE DIRECTED to initiate a Zoning By-Law housekeeping amendment to address the current issues with the Zoning By-Law 1999-52, as amended by 2019-028 and;
  2. Administration BE DIRECTED that, upon completion of the Zoning By-Law housekeeping amendment, the owners of properties believed to be non-complying with Zoning By-Law 1999-52 are to be provided options they must take in order for their properties to be compliant with the By-law.

REPORTS - CAO's OFFICE

14.1

Amherstburg Fire Station 3 Washroom proposal

• It is recommended that:

  1. Administration BE DIRECTED to implement Option #3 immediately, as identified in the report of September 25, 2023 entitled Amherstburg Fire Station 3 Washroom Proposal and stay in place until such time that the new fire station is completed and occupied.

14.2

2023 Special Events Approval – Part VIIII

• It is recommended that:

  1. The following events BE APPROVED:
     1. Witches and Warlock Walk-a-thon – October 14^th, 2023
     2. Howl-O-Ween – October 28^th, 2023

  2. An exemption from table number 3-1(2) of Noise By-law #2001-43, as amended with respect to the operation of any electronic device or group of connected electronic devices incorporating one or more loudspeakers to allow for music BE GRANTED for the following events:

  3. The Special Events Resource Team BE DIRECTED to confirm that the requirements identified by the Committee are met prior to the event.

• It is recommended that:

NOTICE OF MOTION

22.1

Notice of Motion of September 11, 2023 - Centennial Park Field House - Councillor Pouget

• To be deliberated September 25, 2023 - 

  That Council DIRECT administration to negotiate with North Star High School and the Greater Essex County District School Board to use the portion of Centennial Park, the Libro Centre and the Bill Wigle Park, if required for football and other athletic uses, as per their pervious historical agreements and further to that, allow for immediate use of the Field House in Centennial Park to store the North Star Football Team’s equipment and to allow practice to take place in said park, until this agreement can be reached.
