  • That the Economic Development Advisory Committee RECOMMEND to Council to not move forward with any fees for temporary encroachments in relation to item 16.1 and the notice of motion to be heard by Council on June 25, 2024.

NOTICE OF MOTION

  

To be deliberated June 25, 2024


The Notice of Motion states that:


WHEREAS; the Town of Amherstburg has a User Fee By-law 2024-013 that specifies the encroachment fees for permanent encroachments onto public rights of way;


WHEREAS; commercial businesses in the Town of Amherstburg may seek to extend their patios temporarily onto public rights of way, especially during certain seasons or events;


WHEREAS; the use of public space by commercial businesses should be subject to consistent fee structures to ensure fairness and consistency;


BE IT RESOLVED THAT: Administration BE DIRECTED to revise Bylaw 2024-026 for Council’s consideration, to require any commercial business seeking a temporary patio extension onto a public right of way to pay the same encroachment fees as those applicable to permanent encroachments and for this change to be reflected in the Town’s User Fee By-law.

The Notice of Motion states that:


Motion to direct our Mayor Deputy or Mayor to introduce a Notice of Motion to County Council, in order to request a traffic calming study to relocate the 70 km speed limit sign at Lowes and Sandwich Street to South of the five (5) entrances to the Seasons Retirement Home, the Family Health Team, the Pharmacy, Blue Haven Apartments and County Road 20 and Dalhousie Street Intersection.


Further to that, we are requesting the County to investigate the feasibility to consider a crosswalk at the Sandwich/Lowes intersection, to accommodate residents with assisted devices, who reside at the Blue Haven Apartments, and many other residents, to cross safely for their health care needs.
